Lawsuits have a potential to negatively impact city finances depending on “outcomes.”  The majority of the public may not be aware of all these open court cases.

The City has insurance (with various claim limits per occurrence) though Idaho Counties Risk Management Program (ICRMP) to handle claims and assist with legal costs in legal actions.  IF claims/expenses limits are exceeded, that cost falls to the City (aka taxpayers.)

NOTE: This page may not include every active court case naming the city as a defendant nor contain the most current actions/status. It would be too cost-prohibitive to provide all court documents on this webpage. Federal cases may be viewed in the Court Clerk's office at the Federal Courthouse. District court cases can be viewed at the public kiosk in the Bannock County Courthouse.

Sheeler vs. City of Pocatello

  • Parties have chosen to participate in mediation - ADR must be held by 01/19/24
  • All factual discovery to be by 10/31/23
  • The judge issued an order granting a stipulated motion for the transportation of physical evidence across state lines, 7/13/23 (to be examined by expert.) and an order to extend disclosure deadlines for liability experts regarding firearms and ballistics, 8/18/23.

Walker vs. City of Pocatello

  • Over 7+ years, this case has had some counts dismissed & some defendants removed from various aspects. The initial filing does not reflect the status of the case in 2023. This case's documents may be viewed at the Federal Court Clerk's office.
  • A jury trial scheduled last fall was vacated and a Third Amended Complaint and Demand for Jury Trial was filed.  Amended complaint alleges new violation.
  • 02/27/23 Order extended Discovery & Summary Judgment Deadlines.  Discovery due by 03/31/23 and Motions due by 07/28/23.
  • Jury Trial currently scheduled for 11/13/23, 10 a.m.
  • Per court records as of 05/03/23, the court was informed the case settled in private mediation.  City of Pocatello pays $500,000 to settle suit.

Staker Parsons Companies/DBA Idaho Materials & Construction vs. City of Pocatello and Pocatello Development Authority

  • Frigitek’s unpaid contractor is seeking judgment of $670K (+) 
  • Plaintiff awarded a judgment against Frigitek in November 2021 for unpaid amounts plus interest.  Per the Idaho court repository records, the judgment is still owed.
  • A few notices of deposition (and amended notice of depositions) were issued in August. Currently, the jury trial is scheduled for 12/19/23 at 9:00 a.m.
  • Initial Filing - 8/8/22
  • Related to PDA's terminated Frigitek project within the Airport TIF District

Rupp vs. City of Pocatello, Et al

  • Motions for sanctions hearing scheduled for 06/05/23 @ 4:00 PM
  • Jury trial scheduled for 06/06/23 @ 9:00 AM (primary)  and 11/28/23 (secondary) @ 9:00 AM
  • In a 05/24/23 Memorandum Decision and Order, the matter was dismissed.
  • An appeal was filed with the Idaho Supreme Court on 07/28/23.  Also, there's a couple hearings coming up (One is to consider a motion for attorney's fees and costs on 09/11/23 and another to consider a motion for contempt on 10/02/23.)
